Bo Berry and Mary Garcia tried a case in the 134th Judicial District Court in Dallas County on June 4, 2012. Plaintiff alleged our overseas contractor providing maintenance on living quarters in military contractor housing in Iraq was negligent and breached its contract, causing plaintiff to suffer third degree burns over two-thirds of his body. Plaintiffs asked the jury for 34 million dollars and pursued punitive damages.
This appeal was successfully briefed and argued by The Berry Firm, PLLC. The Firm represented a defendant physician and his fertility clinic in an underlying malpractice case. The trial court dismissed the case with prejudice after the plaintiffs failed to file an expert report, as required by Texas law. The Dallas Court of Appeals affirmed, holding that the case was indeed a health care liability claim as argued by the Berry Firm. As such, the case was dismissed with prejudice.
Bo Berry and Mary Garcia tried a trucking accident case in Leon County on September 27, 2011. This was a death case brought against a Fortune 500 Company - the Defendants' 18 wheeler driven by an employee collided with a truck hauling hay from behind while attempting to pass on the left at an intersection. The deceased was a businessman pursuing entrepreneurial projects in the oil industry and plaintiffs sought more than $20 million in damages.
