The Berry Firm represented a corporate client in a complex medical malpractice case. A 37-year-old woman died in the hospital following a low-risk liver surgery. The cause of death was cerebral swelling and herniation. She left behind four children, a husband and her mother. During the last hours of her life, she complained of headaches of 8/10 to 10/10 intensity. Plaintiffs alleged we were negligent in not following our own internal policies and procedures, not calling a doctor sooner, and initially giving the patient Tylenol and estrogen to address the headaches. Because of the number of claimants and multiple theories of recovery, there were 31 blanks on the jury charge for damages alone. After a three-week trial, we received a defense verdict.
